Excerpts From Mr. Millers' Affidavit Concerning David Rushing's Lies

There is nothing in the files of the Commission to indicate that David Rushing, or any other person or entity other than those identified above, has ever been the licensee of KBKH.

I have also reviewed the Promissory Note and related Security Agreement, both dated February 27, 2001, between Turbo Radio limited Partnership and Shamrock Economic Development Corporation. The Security Agreement identifies the collateral for the note as "all inventory, fixtures, furniture, equipment now owned or hereafter acquired wherever located." No mention of accounts receivable, or any other intangible is made in this agreement, and there is no basis on which to believe that such items were ever part of the collateral for the Promissory Note. Hence, the station's receivables have always remained with the station.

1. Proof that Lynn Switzer, district attorney for the 31st judicial district of Texas, is either in total ignorance of, or total disregard of the US Constitution. This is the actual ruling of the Texas Court of Criminal Appeals after many months of stalling by Lynn Switzer. 2. Shamrock EDC board members Jerry Bob Jernigan and Tom Velasquez, led by David Rushing, commit a broad daylight armed robbery on downtown main street with no legal authorization whatsoever.

3. Sonny Hilburn (F.C. Hilburn), Dottie Rushing, Judy Campbell, Archie Overby and National Bank of Commerce, An Office of First National Bank, Waupaca, Wisconsin, aid in the conspiracy by and through David Rushing's friends, family members and a city council member who are employed by the local branch.

4. David Rushing commits direct violations of federal trade laws and illegally asks local businesses to join his unlawful conspiracy against KBKH by releasing an official memo (on Shamrock EDC letterhead) in which he asks local business owners to aid him in continuing his thefts of radio station income.

5. David Rushing commits still more federal trade law violations by seeking to frighten away advertisers by calling them with fraudulently contrived "warnings" against conducting business with KBKH. (Unlawful Restriction of Trade - Federal RICO Law Violations.)

6. Ray Cogburn, former school superintendent of Shamrock Independent School District (Shamrock ISD) "sucks up" in support of David Rushing's criminal behavior and openly admits that David Rushing has asked him to  participate in the criminal conspiracy.

7. A Shamrock Economic Development Corporation (Shamrock EDC) board member boldly recommends that an investigation be conducted concerning Shamrock EDC's "screwing of the radio station"! (That board member was dead shortly thereafter.)

8. Clifton Vaughn, an employee of the city of Shamrock and co-conspirator of David Rushing (whose business was recipient of MANY THOUSAND OF DOLLARS of David Rushing's "government grants") brazenly lies to no end in his efforts at convincing a potential client of KBKH that the radio station is "out of business and is for sale by Mr. David Rushing". (He does all of this despite his full knowledge that KBKH is still operating and that David Rushing has nothing at all to do with it aside from his insidious plot to force the radio station into failing by any and all means at his disposal, legal or otherwise.)

9. David Rushing and/or Dottie Rushing make vicious and childish online attacks that have an uncanny resemblance to the forged documentation used against the radio station owner as "evidence" in hearings! Also, note the name used in the false attacks! Why would David Rushing willingly bring his wife's name into play unless she were a willing participant in his criminal activities?)

10. David Rushing's actual testimony (scanned copies of certified court transcripts) in which he contradicts himself on several key points. (The district attorney was so busy selling and using drugs and child-porn at the time that these "mistakes" apparently were "overlooked". The assistant district attorney, who was promoted into the office of district attorney upon her boss/mentor/friend's arrest, chose to ignore and to "downplay" these inconsistencies and actively coached and even encouraged David Rushing in telling his lies.)

14. Proof that Amarillo's 7th Court of Criminal Appeals (in Amarillo, Texas) doesn't even bother to read documents submitted as a part of cases pending consideration.

Freshly Updated Information: A practicing Washington, DC, communications attorney (with more than 30 years of experience in broadcast licensing issues) weighs in on the matter: David Rushing and/or Shamrock Economic Development Corporation has NOT EVER had any valid claim to the receivables of KBKH. Take a look at the actual loan agreement that so very clearly does not entitle David Rushing and/or Shamrock EDC to anything beyond the "furniture, fixtures and equipment" of the former Shamrock Broadcasting of Texas, Inc. Look at a letter from David Rushing to John Mann and Bill Wade, the two "attorneys" who (along with the criminals in the office of the district attorney) have willfully and maliciously aided David Rushing in repeatedly stealing items to which he is very clearly not legally entitled. Please notice that this particular letter is a proud and open admission to his theft of the public file that he clearly and plainly admits is the rightful property of the radio station. This is the very same public file that David Rushing complained to the FCC about for almost five years as it was not in possession of the radio station! Due to his open admission to stealing it, he is guilty of submitting fraudulent complaints to the FCC which is a crime in itself... (Yet again, the district attorney was so busy selling and using drugs and child-porn at the time that these "mistakes" apparently were "overlooked". David Rushing and Lynn Switzer (the occupant of the office of the district attorney for the 31st Judicial District of the State of Texas) have proudly given the state of Texas a reputation for being heavily involved in such atrocities as predatory lending, drugs, child pornography, obstruction of justice, abuse of power, malicious prosecutions, federal trade law violations, intentionally "misdirected" investigations, willful and malicious violations of numerous other federal laws, rules and regulations...
