David Rushing has continually bombarded various newsgroups, message boards and other internet venues with what he think are questions that "will reveal some wrong-doing" or some such nonsense. Friends have asked me to respond to these questions. I will do that here. However, due to time constraints and the complexity of the answers, I will answer them at a rate of one question each day.
David, what did you pay for the truck that the city bought for you and that you use in stalking us? How many times have you used taxpayer money to fill that gas tank (at more than $4 per gallon) so that you can follow us to see where we're going and what we're doing and with whom we're talking? How much did you pay for your groceries, last week? How much did you pay for heat, last winter? How much do you spend on alcohol or drugs each week? "An undisclosed amount" is the way I choose to leave it. The fact remains, whether I paid $0 or $12,000,000.00, I bought all new equipment, did the required paperwork, legwork, legal work, due diligence and business work to legally obtain ownership and control of a radio station as recognized and authorized by the federal government. You, on the other hand and despite all of your whimpering and whining, did not.
How could Turvaville sell it to you when he sold it to Shamrock Broadcasting in 1999? (Transaction on file with Secretary of State of Texas.)
First off, let me say that this question is answered at least three different times and explained in three different ways for a reason. When reading this answer, please understand that it needs to be clearly understood by some people who are not quite willing to understand what they read on this particular issue so, please pay close attention. This answer will force you to believe in a completely new concept that the entire world has known and understood for some time (with the exception of people in Shamrock Texas, for some odd reason). That concept is that the radio station was not ever owned by "Turbo Radio Limited Partnership"! What Mr. Turvaville sold to Shamrock Broadcasting of Texas, during 1999, was his interest in Turbo Radio Limited Partnership.
Mr. Turvaville, personally, held an 80% interest in the license of (what was then) KRMN. When Mr. Turvaville removed himself from Turbo Radio Limited Partnership (by resigning the position) and was replaced by Shamrock Broadcasting of Texas, that 80% interest in the license remained with Mr. Turvaville, personally. (Read this again, David. It takes a few minutes to sink in for a person with a second-grade level thought process.)
As it was stated on the license and all related FCC documentation, Mr. Turvaville, personally, held 80% interest in the radio station and, as such, when he removed himself from the partnership, that 80% majority interest in the radio station was no longer a part of Turbo Radio Limited Partnership. That 80% controlling interest went with Mr. Turvaville when he removed himself (and his 80% of the license) from the partnership.
The Secretary of State of Texas can transfer control of a partnership (as was done in this instance) but, the Secretary of State of Texas cannot transfer the 80% interest in the broadcast license from the individual(s) holding it (in this case, James Turvaville) to someone new (such as the officers of Shamrock Broadcasting of Texas) without the prior approval of the Federal Communications Commission.
In summary: Mr. Turvaville sold his interest in a partnership (that did not hold the license to the radio station) to Shamrock Broadcasting of Texas, Inc. while retaining 80% of the actual radio station ownership, personally.
This is simply a childishly worded repeat of the above question and, as such, I will refer you back to the answer to the above question as well.
Of the remaining questions that David Rushing claims to have and has posted in numerous locations, all I can say is they are nothing more than intentionally inflammatory slights and attacks against my children. The balance of his "questions" have absolutely no bearing on a radio station in Shamrock and, as such, I refuse to even dignify them with an answer.
