There are two people on Earth who are primarily responsible for the existence of this website. If you (as are we) are tired of reading and hearing about these issues, please feel free to express your thoughts to these individuals as they could've very simply and easily let the matter die a quiet death a long time ago and, due to their own greed, inconsideration and lack of concern for anyone other than themselves, have continued to keep the issues "front and center" in the eyes of the local community and the world.
As we are all aware that Mr. David Rushing Rushing and Mrs. Lynn Switzer engaged in nothing more than desperately seeking to prevent our repeating of facts and truth concerning many numerous screw-ups and illegal acts on their parts, it would serve them both very well to realize that much more could be accomplished through peaceful discussion and kindness than with more nasty and fraudulent personal attacks on their parts. Why should an entire community continue to receive a "black eye" because they - as individuals - lack the fortitude required to say, "OK, we've made a few mistakes and committed several serious crimes in an effort at trying to cover-up those mistakes..." As God is my witness, when I came to Shamrock and offered to PAY IN FULL the debts of the previous management of the radio station, I sincerely believed that I was doing something good for the station and the community. I really thought the offer would be graciously accepted and that everyone would be happy and I would operate a small station that would be welcomed to any event in the community and even considered a blessing to the community. I believed this because I was the one person who sincerely tried to make a failing station work.
Instead, what I found was a small town in which the primary industry (no kidding) seems to be the manufacture, transport and sales of methamphetamines due to the readily available supply of anhydrous ammonia (due to the local farming community) and in which local law enforcement has learned to "share in the profits" by either directly participating or "maintaining silence for a fee".
I fell victim to the "make a difference and clean-up your community" beliefs and honestly thought seeking out and revealing these "indiscretions" was the same as "community service" (even if it was not a direct "on the air" approach).
To date, EVERYTHING I HAVE DONE to "make a difference" has been used against me! There are people in the community who have cursed me for my role in helping to put away the drug-dealing DA. (They seem to feel that he *did* "get a lot of drugs off of the interstate" and, he truly did! But, it was more along the lines of "keeping stock on hand" - through seizures - and "keeping competition out" and he has confessed to this. But, I am also ASSURED by the locals that, were it possible for him to run in the next election, he *would* be voted back into office. He is a "LOCAL BOY"!!!)
Just last week, a lady who turned out to be a teacher at the local high-school e-mailed a VERY nasty message to a person who forwarded it on to me asking why I was at home and not "in prison where you belong". Of course, I refer to the texas Court of Criminal Appeals website that specifies "unfair trial and denial of rights to meaningful appeals". She responded with, "But, by forcing the state to admit this, you're making David Rushing look bad! And, since he is a local boy, that makes the town look bad and we will never support you now!"
Of course, I have to wonder if she sincerely believes that it would be better to have a person who has committed no crime to sit in prison for two years in order to keep David Rushing from "looking bad". She had commented that "If it helped to keep the town from looking bad, yes, I would!" Of course, it will always be my opinion that David Rushing has made *himself* look bad but, I've also been arrested for holding that opinion as well... (Honestly! The local newspaper - the "County Star-News" - ran a front page story on my arrest due to "allowing the expressions of thoughts and opinions on the radio station and the internet websites.")
If there is one thing that I *have* learned it is that there is no point in trying to make a difference as it will truly be resented by all. EVERYONE has "looked the other way". The FCC has determined that, other than going after ME for various violations (most of which were due to being forced out of building AT GUNPOINT), they "have no interest in the situation" and that "this is a matter for the local district attorney" (who was the drug-dealer at the time) and his assistant, who *was* aware, and is proud to admit it and who is now his successor since he is now in the place in which he had so avidly TRIED to put (and keep) ME!!!
If you are seeking appreciation, GIVE UP! It ain't gonna happen! This business is not what it was just 20 or 30 years ago... This sound rather bleak and cynical but, I am speaking as a person who had honestly tried to do something good and has had "The American Dream" turn into "The American Drug Nightmare" in which even the federal government (who issued my license to own and operate a radio station) tell me "Oh, we are not here to protect you! We are only interested in finding VIOLATIONS WITH LICENSEES! The people who've done this to you are not licensees. YOU are the only licensee involved here and we are here to POP YOU for violations and, by the way, "violations were forced at gunpoint" is NOT a valid excuse!!!"

You may or may not be aware of the many numerous false claims that have been filed by the Shamrock Chamber of Commerce director seeking to have our radio station "killed" as a viable business. These have included such asinine and idiotic claims as a civil suit in which he indicates that he is actually the "owner" of the radio station and that we have built "a new radio station" which is preventing the operation of "his" radio station.
Other, even more ridiculous claims abound and, quite honestly, we're tired of trying to keep a radio station alive in a town that (according to the latest U.S. Census Bureau statistics) has lost so many people during the recent past that the population has dropped from almost 15,000 to 2,000 (if the facts are "bent" enough to ignore the others who've left in droves since the 2000 census was taken).
Despite the determination of Mr. David Rushing to kill-off yet another local business, we have stayed with Shamrock for more than 5 years (as of February 14, 2007). This has more than adequately demonstrated two most important points:
Mr. David Rushing has been completely unsuccessful in his unlawful restriction of trade conspiracy that was designed to bring about the financial ruin of the radio station and the lives of my children, for whom I had originally purchased the station.
As Mr. David Rushing is still in power within the city, it is most obvious that the local population either has not a clue as to the damage that Mr. David Rushing is subjecting this once great and proud community or the local population supports Mr. David Rushing in his criminal bid at destroying - by any means at his disposal - any and all businesses that are bold enough to refuse to go along with the violations of federal laws and total disregard of individual constitutional rights as advocated by Mr. David Rushing and his band of thieving cronies.
During the next several weeks we will be preparing to give the local crime ring just exactly that for which Mr. David Rushing has so very unsuccessfully sought during this past five (plus) years: The satisfaction of having a community without a local radio station. But, not in the manner in which he has been hoping. We have now operated in the area long enough to establish the fact that it is not Mr. Rushing's criminal conspiracy that has caused us to remove the radio station from the local community. We have elected to simply remove our station to a community in which growth and business is embraced and greed is not nearly such a rampantly burning wildfire that is eagerly waiting to consume everything within sight!
I am also very well familiarized with the (totally falsified) stories of the "foreclosure" that supposedly happened against my radio station back in 2002. For the first time ever, and for the record, it should be known that I have not ever, at any time, owed Mr. David Rushing or Shamrock Economic Development Corporation so much as a thin dime! I have not ever sought, obtained or even considered applying for a loan involving these people in any way, shape or form! The original offer that I had made to them was to pay-off (in full) the outstanding debt of Jersey Boy Media, Inc. who was the previous LEASEHOLDER of the license of (what was then known as) KRMN and is now KBKH. That debt was not in any way associated with me, my family or our business. I only offered to pay it off so as to retain the original radio station properties. Mr. David Rushing and SEDC relieved me of those desires upon refusing to accept the pay-off of that debt which was not mine. The offer to pay-off that debt was not required and was more an act of kindness than anything else. The debt involved a loan that I had offered to pay involved the original equipment of the radio station that was mostly hauled to Florida by the constituents of Jersey Boy Media, Inc., the former radio tower and transmitter site and the building that is located at 201 North Main Street in Shamrock, Texas. That loan could not and did not attach the station license or the station's income as to do so would violate several federal laws.
Also, I am aware of the propagation of the false claim that Mr. David Rushing and Shamrock Economic Development Corporation had, at some time during 2002, "hired" me to be their "employee" and to manage "their" radio station as such. To this absolutely idiotic claim, I would ask for a showing of some form of evidence that Mr. David Rushing and/or Shamrock Economic Development Corporation has ever (at any time in the history of the Earth) owned even so much as a tiny percentage of a single percent of the controlling interest in this or any other radio station. It simply cannot be done as these people have never had even so much legal "control" of a radio station so as to be able to legally designate who cleans the toilets! Now, I ask you: How is it that a person who has absolutely no ownership in (or legally granted control of) a federally controlled and regulated business would seem to be able to fantasize that they can hire a manager for that business when the person supposedly "hired" to be "manager" is already the only federally recognized controlling interest within the local community? Failing this test, how about asking Mr. David Rushing to produce something so basic as even a job application filled out by me? How about asking Mr. David Rushing to produce a W-4 (withholding allowances) form that is required by federal law upon being hired? How about asking Mr. David Rushing to show some proof of employee withholdings as required by state and federal laws?
As for the other false claims that have been spread far and wide by this (in my most sincere and carefully thought out opinion that is based on more than five long years of observing this person) lying, deceitful and despicable person in which he falsely claims that I've "stolen" from "his radio station", I would suggest that a person need look no further than into the background of the district attorney who sought and obtained that "indictment": He's currently serving a five year sentence in a federal prison and is also under indictment at the state level (not less than 10 nor more than 90 years) on drug and firearms charges and our radio station had reported on this DA's wrong-doings during August and September of 2002. Hey! That's some 14 to 15 month BEFORE his arrest!!! Does it require the mental faculties of a full-blown genius to realize that this criminal had much to gain in aiding Mr. Rushing's efforts to "silence the radio station" and to bring an immediate stop to any future reporting on his drug and firearms related crimes?
Based on the above information, I have elected to give Mr. David Rushing the dubious distinction of having been the Chamber of Commerce Director and Economic Development Director who has single-handedly been responsible for the removal of yet another business during his terms in these offices. I applaud Mr. David Rushing's determination and drive in his efforts at making life in Shamrock a virtual impossibility for my family and others due to his continuing efforts at costing each and every possible penny in each and every possible situation. In my opinion, Mr. David Rushing should be given some form of award for his never ending preparation and filing of the many hundreds and hundreds of pages of complaints against my business as the careful preparation of all of this documentation has obviously also taken many hundreds, if not even thousands, of hours of time that would've only been otherwise wasted on such worthless pursuits as promoting our city and seeking to bring in new business and industry and, as we all are so very well aware, we need to kill off all existing business before we can engage in bringing in new business. Right? (This is sarcasm, by the way...)
Therefore, it is my intention, at the earliest possible time, to formally and officially remove (as completely as possible) the local radio station from the city of Shamrock and to relocate it to an area that is much more friendly to business, promotion, growth and development. That is not to say that I feel a majority of Shamrock residents are unfriendly but, as Mr. David Rushing has now begged the federal government for the removal of the radio station and the local citizens have refused to rise-up and demand his termination for these and other atrocities, I feel that we can now establish that this course of action will so very obviously be in the best interests of the community.
Please give all credit for the loss of the local radio station to the person who has made such great and Herculean efforts to bring it about and deserves it most: Mr. David Rushing. It took him more than five long years to convince me that Shamrock does not wish to have a radio station through which to promote itself to the world. Now, I'm finally seeing that he is absolutely correct by observing the citizens of our community in their continued support of Mr. David Rushing by signifying their approval and continuing to allow this wanton destruction of local business, industry, the local economy and our families so that "the chosen few" may profit at the expense of "the working class".
Please stand by as we completely rebuild our web site from the ground up. This should take about a week to ten days for completion.
